What's the problem there? We've never had the right to silence in the UK.* The USA's take on a person's rights isn't universal.

*That is to say, if you're arrested or on trial, not saying anything can be used against you.

I think the right to refuse self incrimination is very important in any democracy. What's next? Getting rid of the presumpton of innocence and adopting one of guilty until proven innocent?

Edit: i looked up the right to remain silent in uk.

Looks like UK had varying versions of it until 1994 when they basically got rid of the right for good. Perhaps the ministry of information has been busy revising the schoolbooks again.

The French official certainly isn't the first, nor will he be the last, to have his image tarnished, rightly or wrongly by alleged sexual misconduct. I personally don't condone the media that is more concerned in sensationaling stories instead of waiting to get facts right (see duke lacross players).

I think that due to the potential damage to a person's reputation from mere accusations, both alleged victim and perpatrator should have their names censored until the trial is over.

However a picture of a man in handcuffs is far different from a man being compled to testify against himself and/or spouse. The worst that could be said is that the potential jury pool would be tainted by the image.

Ah, leave it to Pinoy to follow up two incendiary straw men posts with something reasonable! Except that DS-K was not accused of "sexual misconduct". He was accused of rape. In the legal sense "sexual misconduct" usually refers to sexual interactions with someone over whom one has authority. It can also refer to sexual harassment.

You want to talk scary government overreach in our country, Pinoy? How about Weev, Matthew Keys and Aaron Swartz? Convicted rapists get a year or two of juvi; internet assholes, pranksters and activists (I'll let you guess which I think is which) face longer terms (up to 25 years) and thousands of dollars in fines for "damages" even though the only "damage" they caused was embarrassment.

Also note that Weev suffered no repercussions from the Feds when he published the home address and Social Security Number of a female blogger who had been receiving threats of death and sexual violence towards herself and her children. They only cared when he decided to troll poor vulnerable AT&T.

IMO, these cases are a lot more frightening and a bigger threat to our civil liberties than having mandatory training, background checks, insurance and registration before you are allowed to purchase an assault weapon.

Don't ask for logic from the Tea Party.

On a similar note, some conservative group robo-called my dad asking for donations. The message said they needed help "to defeat Obama." He wanted to talk to a real person to ask them how they plan to do that when he's be elected to a second term.
