In civil court your both making a claim to the rights and then the victor is the one who the jurty/judge/arbiter decides legally owns the images. So it's not perjury in any way shape or form and the whole point of the civil court is to prove that the other person is wrong.

Second, how about you just contact the sites she's posting on, like here, facebook, DA, whatever and tell them that you own the copyright to said image and that you want it removed. They'll probably require proof and if you can prove you own the rights then they should be able to take them down. If they don't then you can threaten them with legal action and if they still don't comply, you can probably cheaply get a lawyer to contact them. I don't see a real reason for this to go all the way to court so I'm sure some lawyers offer a cheap cease and desist service.
I took your advice and Facebook removed the photos, tumblr also removed them. Upon reading the appeal (she did it once) it does say perjury since it is a legal testify according to the dmca which is what we use. Since the photos have been removed im leaving her alone. That was the deal I told her before. Thank you for the advice.

the photos still are posted on twitter and here, but thanks to the cosplayer, she went to the police and said this is harassment and now I'm scared to use the DMCA rights to get the rest of the photos removed. HAD she gotten replied nicely, or had she gotten her lawyer like she claimed back in OCTOBER then we might not be having such a major problem. on top of that she's claiming a verbal contract from 2012 that can NEVER be changed... you badmouthed the photographer and continue to do so..

don't let yourself be intimidated. If you own the photos, you have the right to have them removed.

Edit: Just make sure you stop making contact with her directly. Depending on what you say and the nature of your dialogue, it could be harassment, but you just contacting the sites requesting that the images be removed shouldn't be a problem. Just leave her alone and if she contacts you, just save the email until a later date, don't reply.

I hadn't been in contact with her directly, It was whomever she had run my hijacked site who claimed it wasn't her. but I will NOT contact her again. I contacted tumblr, twitter, FB, and here to have them removed. She counter claimed she owns them to FB though. I'm currently in talks with my lawyer who said the same thing earlier about doing the DMCA route. This will take a while to get those removed permanently though because of funds. It's amazing how a simple request turns into a HUGE drama fest after I was already defamed twice. I have zero contact with her or my old website, but have added a request and notice to my site about mis-use of my photography for future cases.

I would like to ask what is the best camera or is it a camera phone for a wide angle picture. I saw a commercial about it before. It was about kids in costumes for a play of some sorts. And the photographer was able to move the camera and practically scan the long line of kids for the picture. I can't find it anymore though. Help please.

You're probably thinking of panorama or stitching mode, the phone basically takes a bunch of photos and then stitches or blends them all together using software to make one large photo.

Agreed, many smart phones today have softwear that stitches frames together to make a panorama. probably what you saw on the commercial.

The commercial you're talking about was advertising a windows phone using pano feature.
That said, any camera is capable of producing images that can later be stitched together

Keep in mind, there is much to it than just moving camera along the line of whatever your subject is; its never as easy as commercials make it seem. I've been stitching panos for good 10 years now.

Does anyone have a link or something to a great example for a release form... I don't want what happened before to EVER HAPPEN AGAIN with photoshoots... some of my new friends want me to do photoshoots, but i want to get release forms made up first.

...kind of on subject....There's actually some great smartphone apps where its digital and it can email to both of you instantly for your records. Just type in "model release" in the android app store or the apple app store and youll find several good options.

figment I don't know that you want the classical model release, that is more for a different purpose like licensing the photo to a third party for use in advertising or brand association.

What you want is a document (contract) that outlines how you and the subject can use the photos produced as a result of the shoot.

Based on past posts and past troubles, I think he actually is looking for a model release, so there's no confusion as to who owns the photos, and what the photographer can do with the photos.

Usage license would be a separate document, you'll need one of those as well so the subject/model can legally use and display your photos.

That's how I do it, anyway. Two separate documents. My cosplay photography release is more wordy than I think it should be, but I'm operating in CYA mode after some of the stuff that other photographers dealt with in 2013 - the Heroes of Cosplay usage mess, and cosplay-pillow-gate.

I do make sure to go over the release point-by-point with the subjects, before shooting.
